Terms of Service

Welcome to HappyFace! These Terms of Service ("Terms") govern your access to and use of the HappyFace mobile application. By creating an account or using HappyFace, you agree to be bound by these Terms.

1. Eligibility

• You must be at least 13 years old to use HappyFace
• If you are under 18, you must have permission from a parent or legal guardian
• You must provide accurate information when creating your account
• You are responsible for maintaining the security of your account credentials

2. Account Registration

• You must create an account to use HappyFace
• One person may only create one account
• You may not impersonate another person or entity
• Your username and profile must not violate our Community Guidelines
• You are responsible for all activity under your account

3. Acceptable Use

When using HappyFace, you agree NOT to:

3.1 Prohibited Content

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of privacy
• Share sexually explicit content or nudity
• Post content promoting violence, terrorism, or hate speech
• Share content that infringes intellectual property rights
• Post spam, advertisements, or unsolicited commercial content
• Share false or misleading information

3.2 Prohibited Behavior

• Harass, bully, or intimidate other users
• Impersonate others or create fake accounts
• Engage in any form of fraud or deception
• Attempt to hack, compromise, or gain unauthorized access to accounts or systems
• Use bots, scripts, or automated tools without permission
• Collect or harvest user data without consent
• Interfere with or disrupt the service

4. Content Ownership and License

4.1 Your Content

• You retain all rights to content you post on HappyFace
• You are responsible for the content you share
• You grant HappyFace a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content to provide the service
• This license ends when you delete your content or account (subject to reasonable time for removal)

4.2 Other Users' Content

• You may not download, copy, or redistribute others' content without permission
• Respect intellectual property rights and copyright
• Report content that violates these Terms using the report feature

5. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

6. Content Moderation

• We reserve the right to remove content that violates these Terms
• We may suspend or terminate accounts that repeatedly violate our policies
• Users can report inappropriate content or behavior
• We are not obligated to monitor all content but may do so to enforce these Terms

7. Intellectual Property

• HappyFace, including its design, features, and code, is owned by Lesmel Hammeren Alonso
• Our trademarks, logos, and brand assets may not be used without permission
• You may not reverse engineer, decompile, or attempt to extract source code from HappyFace

8. Termination

8.1 By You

• You may delete your account at any time through app settings
• Deleting your account will remove your profile and content from HappyFace

8.2 By Us

We may suspend or terminate your account if:

• You violate these Terms or our Community Guidelines
• You engage in illegal activity
• Your account is reported by multiple users for violations
• We are required to do so by law
• We decide to discontinue the service

9. Disclaimers and Limitation of Liability

9.1 Service Availability

• We do not guarantee that HappyFace will be available at all times
• We may modify, suspend, or discontinue features without notice
• We are not responsible for any loss of data or content

9.2 Limitation of Liability

• We are not liable for any damages arising from your use of HappyFace
• We are not responsible for content posted by users
• We are not liable for any third-party actions or services
• Our total liability shall not exceed the amount you paid us (which is $0 for free users)

10. Indemnification

You agree to indemnify and hold harmless HappyFace and its developer from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you post on HappyFace
• Your use of the service

11. Dispute Resolution

• These Terms shall be governed by the laws of Norway
• Any disputes shall be resolved through good faith negotiation
• If negotiation fails, disputes may be brought in the courts of Norway

12. Changes to Terms

• We may update these Terms from time to time
• We will notify you of significant changes through the app or email
• Continued use after changes indicates acceptance of updated Terms
• If you do not agree to updated Terms, you must stop using HappyFace

13. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and HappyFace
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• No Waiver: Failure to enforce any provision does not waive our right to enforce it later
• Assignment: You may not transfer these Terms; we may assign them without notice

14. Copyright Infringement

If you believe content on HappyFace infringes your copyright, please contact us with:

• Description of the copyrighted work
• Location of the infringing content
• Your contact information
• Statement of good faith belief that use is unauthorized
• Statement of accuracy under penalty of perjury

15. Community Guidelines

In addition to these Terms, all users must follow our Community Guidelines:

• Be Respectful: Treat others with kindness and respect
• Be Authentic: Don't impersonate others or create fake accounts
• Be Safe: Don't share personal information publicly
• Be Legal: Don't post illegal content or engage in illegal activity
• Be Responsible: You are accountable for your content and actions
